Design fee splits with certifying consultants in the Northern Territory

In the Territory, the people who certify a design are registered by the Building Practitioners Board, and much of the design work around them is done by drafters. That split of roles maps naturally onto split payments.

Security of payment in the NT

The Territory’s scheme is the Construction Contracts (Security of Payments) Act 2004. It sets rules for payments under construction contracts and provides for adjudication of payment disputes.

Building Practitioners Board categories

The NT Building Practitioners Board registers, among others:

  • building contractors (residential and commercial)
  • building certifiers
  • certifying engineers (hydraulic, mechanical and structural)
  • certifying plumbers and drainers
  • certifying architects

What the board list doesn’t include

The board’s practitioner categories don’t include a building designer or draftsperson category. A Darwin drafter therefore usually works alongside a certifying engineer or architect, and a split schedule lets the drafting stage and the certification stage be invoiced, and paid, separately.

Planning in the NT

Planning runs under the Planning Act 1999. The NT Planning Scheme 2020 applies across the Territory except Jabiru, and the Development Consent Authority decides most development applications.

Example: a Darwin elevated home

ExampleExample only: sample figures, not a quote
Stage 1: design and DA drawings (drafter)
A$3,520
Stage 2: cyclone structural design and certification (certifying engineer)
A$3,850
Stage 3: construction drawings (drafter)
A$2,750
Client pays per stage
A$10,120 total

Illustrative only. DrafterShare would issue each stage invoice from one schedule and split payment to the drafter and engineer (planned).
